Terms of Service
The license, the refund policy, and the limits of what we promise.
In plain terms: you are buying a license to use BiggSky, not the software itself. Your images and your results are entirely yours. The software is in beta and is sold as it is. If it is not right for you, tell us within 14 days of buying and we will refund you.

1. Agreeing to these terms
By downloading, activating or using BiggSky, or by buying a license, you agree to these terms. If you do not agree, do not use the software. If you are agreeing on behalf of an organization, you confirm you are authorized to do so.
2. What your license permits
Subject to payment and to these terms, we grant you a non-exclusive, non-transferable license to install and use BiggSky for the edition and period you purchased.
You may:
- install and use BiggSky on up to 5 computers you own or control, active at any one time;
- use it for personal, educational and research work, and for paid work — selling prints, taking commissions, being paid to process someone else's data — for as long as what BiggSky earns you stays under US $50,000 in any twelve months. Above that you need a commercial license, which is a conversation rather than a penalty: write to us. The full definition, including what does and does not count as revenue, is in the EULA, section 1C;
- move it between machines by releasing a seat and activating another.
You may not:
- share, resell, sublicense, rent or transfer your license key;
- reverse-engineer, decompile or disassemble the software, except where law expressly permits it despite this term;
- circumvent, disable or tamper with the licensing mechanism;
- operate it as a paid processing service for third parties without a separate agreement — write to us, this is available.
We retain all rights not expressly granted. BiggSky is licensed, not sold, and remains the property of KB Imaging Solutions LLC.
3. Seats and activation
A seat is a computer on which the license is currently active. A trial permits 3; a paid license permits 5. Seats are concurrent, not cumulative — releasing a seat frees it for another machine, and you may do this as often as you need through the License tab in the application or at biggsky.com/activate/seats.html.
There is no account and no password. Your license is your email address plus a 16-character key, and the two must match at every validation. Keep them together.
A computer is recognized by hashed hardware identifiers. Replacing a system board or reinstalling the operating system may register as a new machine and consume a seat; the seats page above lets you release the old one without needing access to it.
BiggSky re-checks the license roughly weekly when you close it. Between checks it runs offline. If it cannot reach us, it continues working and shows an offline indicator rather than locking you out. A perpetual license can stay offline for as long as the version does not change, and an annual or trial license until its expiry date. A new version needs validating once, online or through offline activation.
4. The free trial
The trial runs for 30 days and gives you the complete application, with no watermark, no export restriction and no card details required. The clock starts when you validate the key on an installed copy, not when you request it.
One trial per person and per machine. Requesting another with the same address re-sends the key you already have.
5. When a license ends
You do not lose your work. When a trial or subscription lapses, BiggSky switches to Free mode: press Validate on the License tab and everything you have already processed still opens, displays and exports. The premium operations — stacking, deconvolution, the one-click pipeline, GPU and multi-core acceleration, star removal and analysis — require a current license.
Files you have created are yours permanently and in open formats. Nothing we do can take them away from you.
6. Payment, renewal and price
Payment is processed by Stripe. Prices are in US dollars and exclude any tax that applies where you are.
Perpetual licenses are a single payment for the major version you buy. Updates within that major version are included. A future major version may be a paid upgrade.
Annual licenses renew automatically each year at the rate you are on until you cancel. Cancel any time through the customer portal link in your purchase email, or by writing to us; cancellation takes effect at the end of the paid period and you keep access until then.
A discounted founder rate, once applied to a subscription, holds for as long as that subscription runs without interruption. If it lapses, the rate at the time of resubscribing applies.
We may change list prices. A price change never affects a perpetual license already bought, and never affects a subscription mid-period.
7. Refunds
If BiggSky is not right for you, email support@biggsky.com within 14 days of purchase and we will refund you in full. No form to fill in and no reason required, though we would genuinely like to know what went wrong.
Refunds are issued to the original payment method and normally reach you within five to ten business days, depending on your bank. The license is cancelled when the refund is issued.
Two things worth saying honestly:
- Please use the trial first. It is the same software for 30 days with nothing withheld, so you can confirm BiggSky suits your data and your computer before spending anything.
- Annual renewals. If a renewal catches you by surprise, tell us within 14 days of the charge and we will refund it and cancel the subscription.
We may decline a refund where a license has been shared, resold, or used to circumvent the trial limits.
8. Beta software
BiggSky is in public beta. Releases are frequent, features change, and defects are expected and reported openly. We say so on every page rather than in the small print because it should affect your decision.
What that means practically: keep your original captures. BiggSky does not modify your source files, but no beta software should be the only place your work exists.
9. Third-party components
BiggSky requires the MATLAB Runtime, which is distributed by MathWorks under its own license and installed alongside the application. GPU acceleration on Windows uses NVIDIA components subject to NVIDIA's terms. These remain the property of their owners and nothing here grants you rights in them.
10. Warranty disclaimer
We work hard on this and we stand behind it, but as a matter of law: BiggSky is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the software will be uninterrupted, error-free, or that it will produce any particular result from any particular data.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this may not apply to you. Nothing here limits rights you have under consumer protection law that cannot be waived.
11. Limitation of liability
To the fullest extent the law allows, KB Imaging Solutions LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, lost imaging time or lost opportunity, arising from your use of or inability to use BiggSky — even if we were told such damages were possible.
Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Again, nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
12. Termination
You may stop using BiggSky at any time. We may suspend or terminate a license that breaches these terms — in practice, that means sharing keys or tampering with licensing, and we will contact you before acting unless the breach is deliberate and obvious. On termination the license ends; Free mode and your existing files remain.
13. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. If you are a consumer, this does not deprive you of the protection of mandatory laws where you live, and you may bring proceedings in your local courts.
14. Changes to these terms
We may update these terms. The effective date above changes when we do, and material changes are noted in the release notes. Changes are not retroactive: the terms you agreed to when you bought a perpetual license continue to govern it.
